The second day began with a lecture on the current political atmosphere
in California, followed by a briefing of issues pertinent to our profession.
There was also a presentation concerning subjects to discuss with our
respective assembly-persons and senators during our visits later that
day.
The upcoming bills and issues that we were briefed on were as follows:
AB 573 (Wolk/Jones) Fair Public Works Contracts (SUPPORT):
AB 573, a bill jointly sponsored by the AIACC and the Consulting Engineers
and Land Surveyors of California (CELSO), will prohibit the uninsurable
and unfair indemnification provisions commonly found in contracts between
local public agencies and design professionals. I spoke with Marcia Garcia
of Pedro Nava's office, as he had to cancel his meeting with me at the
last minute, and she agreed that they should be able to support this bill.
AB 2914 (Leno) Remove Sunset Date on Architectural LLP Law (SUPPORT):
AB 2914, the AIACC-sponsored bill will eliminate the sunset date on the
law that allows architectural firms to organize as Limited Liablility
Partnerships. Again, Ms. Garcia felt Mr. Nava would support this bill,
as well. [This bill has since passed.]
Residential Construction Defect Litigation:
This will inform Legislators how residential construction defect litigation
impacts the ability of architects to design attached ownership housing,
and how design professionals need to be a part of the solution. Ms. Garcia
asked for more information, in order to possibly help develop a bill,
or at least be informed about the issue.
Commercial Accessiblility Litigation:
This is intended to offer architects as a resource to the Legislature
during its effort to change state law to stop frivolous lawsuits filed
under California's Disabled Accessiblility Law. Ms. Garcia felt Mr. Nava
could support such a bill.
